Read about the new law here... Page 16 - 21

This is something that is going to effect every single one of us who do this for a living or a hobby! Although the chances of being caught are slim, it is still complete BS how they can try to govern this.

    Re: Sign The Petition

This has to do with GSM phones. We don't unlock phones on CDMA networks, we flash them. So, no illegal. I have signed it though because that's a pretty stupid law.

It makes it illegal for CDMA as well as GSM. The concept is the same. There is no reason why CDMA would get a pass on this. Had they made reference to GSM in their ruling then i would agree.

BY DECREE OF THE LIBRARIAN OF CONGRESS
IT SHALL HENCEFORCE BE ORDERED THAT AMERICANS SHALL NOT UNLOCK THEIR OWN SMARTPHONES.
PENALTY: In some situations, first time offenders may be fined up to $500,000, imprisoned for five years, or both. For repeat offenders, the maximum penalty increases to a fine of $1,000,000, imprisonment for up to ten years, or both.*

Edit: this smells like the music download/DMCA/napster thing all over again.

I just caught wind of this on reddit, some post about canada making cell phone unlocking mandatory in the same week the US outlaws it. This is quite a blow to everything I had planned.

The new law (which is supposed to be made by Congress, Not some moron that works for the library of same) is basically bullsquash. If you paid for a phone and own that phone you should be able to do with it as you please, including smashing it with a freakin hammer!!!

    I also sign this petition!!!

You're allowed to smash it with a hammer.... Just not move it to another carrier...

Yeah that seems strange. Thanks for putting it in perspective.

I'm waiting to read a story about the first person who tried to activate a post Jan 28, 2013 unlocked phone from a different carrier. I wonder if any carrier will ask who unlocked it or if their system will deny it.

The ruling didnt say it was illegal for a carrier to activate another carriers unlocked phone. Not did it say it was their job to police it. But that wont stop DMCA from suing carriers over the matter.

From what I understood from reading, that modifying the phones "software or firmware" is what they say we are doing. And we are not allowed to do that. Also, we are not allowed to redistrbute the software on the phone as well. We dont own the software on the phone according to the Library of Congress. However, here's where it gets interesting Hello! Isn't Android covered under the GPL and Apache!? Free to edit and redistribute as we please, OPEN SOURCE right? Doesnt this law somewhat contridict GPL and Apache?

I know that just covers Android, not Apple devices, RIM, Windows Mobile and others. I guess they could try to say that those devices could have their "software or firmware" edited, but how can they restrict Android OS. Just a thought.

yea, i think they claim they are leasing the OS to us during the contract period. Therefore they think they have a right to prevent unlocking during the contract. It would be an interesting legal argument to see if it was legal to replace the OS, unlock it then put it on a differnt carrier. And yes, open source adds a new element to the argument.
